What to know before you call a lawyer — short, plain language, by topic.

Podcast: Enduring power of attorney to protect a family businessIn Hebrew · 5 minutes

Litigation & Civil Law

The office conducts proceedings in court, arbitration and mediation. The approach: try to resolve it through negotiation first, and when needed, arrive in court fully prepared.

Every case is handled personally by Adv. Weissfeld, from the first meeting to the judgment.

  • Monetary claims and debt collection
  • Real-estate, nonprofit, estate and corporate disputes
  • Defamation and intellectual property
  • Arbitration and mediation

Can a dispute be resolved without going to court? Often, yes. Negotiation, mediation or arbitration save time and money. We assess which route fits your case.

How long do I have to file a claim? For most civil claims in Israel the limitation period is 7 years, with exceptions. It is best to check early.

Enduring Power of Attorney

An enduring power of attorney lets you, while you are of sound mind, appoint someone you trust to handle your personal, medical and financial affairs in the future.

Without one, if decision-making capacity is lost, the court may appoint a guardian — not always the person you would choose. Adv. Weissfeld is licensed by the Ministry of Justice to draft enduring powers of attorney.

  • Introductory meeting — who will be appointed, for which matters, and your instructions
  • Drafting and signing — a tailored document with a full explanation
  • Filing — with the Administrator General, online
  • Also suited to adult children supporting an ageing parent

When should I make an enduring power of attorney? While you are of sound mind and not under pressure. Once capacity is lost, it can no longer be made.

Can spouses sign one joint document? No. Each spouse needs a separate power of attorney of their own.

Where is the document kept? It is filed with the Administrator General and takes effect according to the conditions set in it.

Inheritance & Family Law

Estates, guardianship, wills and enduring powers of attorney are the office's special niche. A properly drafted will prevents years of family disputes.

Adv. Weissfeld also serves as a court-appointed estate administrator — locating assets, paying debts and distributing fairly.

  • Drafting wills — individual or mutual for spouses
  • Estate administration, including as administrator
  • Will contests and court proceedings
  • Guardianship

What is the difference between an inheritance order and a probate order? A probate order is requested when there is a will. An inheritance order is requested when there is none, and the estate is divided by law.

Is a handwritten will valid? Yes, if written entirely in the testator's own hand, signed and dated. A will made before witnesses or a lawyer reduces the risk of a contest.

Real Estate

A real-estate deal is often the biggest transaction of your life — and most of the risk lies in the details before signing.

The office handles sales and purchases, land rezoning and development projects, including planning and tax aspects.

  • Sale and purchase transactions
  • Land rezoning and development projects
  • Planning and tax review before signing

Should I see a lawyer before signing a memorandum of understanding? Yes. In Israel a memorandum can be as binding as a contract. Have it checked before you sign.

Which taxes apply to a property deal? Usually purchase tax for the buyer and capital-gains (betterment) tax for the seller, sometimes also a betterment levy. The amounts are checked before signing.

Commercial Contracts

A good contract prevents the next dispute. The office drafts and reviews agreements for technology and high-tech, acquisitions, franchising, international transactions and family businesses.

With three working languages, agreements with foreign parties are drafted and explained directly.

  • Commercial, technology and high-tech agreements
  • Acquisitions and franchising
  • International deals — Hebrew, English, French
  • Founders' agreements and family businesses

Which law applies to a contract with a foreign party? The parties can set the governing law and jurisdiction in the contract. Decide it up front rather than leaving it open.

Why does a family business need a written agreement? It sets ownership, roles and exit terms — and prevents disputes when circumstances change.

Class & Group Actions

When a small harm affects many people, a class action turns it into a case worth pursuing.

The office has experience in claims with a broad base of claimants, including aviation and tourism cases.

  • Class actions
  • Group claims with many claimants
  • Aviation and tourism

What is a class action? A claim filed by one plaintiff on behalf of a large group harmed by the same act. The court must certify it as a class action.

Do group members have to pay? Usually not. Fees and awards are set by the court at the end of the proceedings.

Non-Profits & Organizations

The office sets up nonprofits (amutot) and supports them along the way: founding documents, dealings with the Registrar of Nonprofits and court representation.

  • Setting up nonprofits
  • Ongoing support and dealings with the Registrar
  • Court representation

How many founders are needed for a nonprofit? At least two. The application is filed with the Registrar of Nonprofits together with articles of association.

What is a proper-management certificate? A certificate from the Registrar that the nonprofit files its reports and operates lawfully. It is often required for donations and grants.

Insolvency & Debt Arrangements

Accumulated debt does not disappear by itself. Israel's Insolvency and Economic Rehabilitation Law gives individuals and companies a path to settle their debts and start over — and gives creditors a path to collect what they are owed.

The earlier you act, the more options you have.

  • Insolvency proceedings for individuals and companies
  • Debt arrangements and settlements with creditors
  • Representing creditors and filing proofs of debt
  • Defence against collection proceedings

Who can open insolvency proceedings? Both individuals and companies, and a creditor can also apply against a debtor. The conditions are checked in a meeting.

Are the debts erased at the end? At the end of a successful process a discharge from some or all debts may be granted, under the conditions set in the proceedings.

Privacy & Data Protection

Any business that keeps names, phone numbers or customer information is subject to Israel's Privacy Protection Law and data-security regulations. Amendment 13 tightened the requirements and expanded enforcement powers.

  • Mapping the data the business holds and what it requires
  • Privacy policies and data-processing agreements with vendors
  • Breach response and reporting to the Privacy Protection Authority

Does the law apply to small businesses? Yes. Any business holding a database about people is subject to it; the obligations vary with the size and sensitivity of the database.

What should I do after a data breach? Act fast: stop the leak, document it and, in serious cases, report to the Privacy Protection Authority as the regulations require.

Employment & Executive Compensation

A senior executive's employment agreement sets not only pay but also what happens when the parties part ways. The office advises executives and companies on both sides.

  • Personal employment agreements for senior executives
  • Bonuses, equity compensation and options
  • Termination, non-compete and confidentiality

Is a non-compete clause enforceable in Israel? Only to a limited extent. Labour courts enforce it mainly to protect trade secrets or another legitimate interest, for a reasonable period.

How are employee options taxed? Usually under Section 102 of the Income Tax Ordinance, on the track set in the plan. Check the track before signing.

Notary Services

A document that must be recognised abroad — or a foreign document that must be recognised in Israel — goes through a notary.

Because Gad is also a lawyer, a document that needs both legal drafting and notarisation is handled in a single meeting.

  • Notarial certifications for Israel and abroad
  • Notarised translations — Hebrew, English, French
  • Signature authentication for banks and embassies
  • Apostille and Foreign Ministry certifications

What is an apostille? A certificate attached to a public document so it is recognised in Hague Convention countries without further embassy legalisation.

Which languages can be notarised at the office? Hebrew, English and French. A notary certifies translations only in languages they master.
